Welcome to Unpanic. These terms are written in plain language because transparency matters. By using our app, you agree to these terms. If something isn't clear, please reach out—we're here to help.
1. Agreement to Terms
By accessing or using Unpanic ("the App," "our Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the App.
1.1 Who Can Use Unpanic
- You must be 18 years or older
- You must be capable of forming a binding contract
- You must not be prohibited from using the Service under applicable law
1.2 Changes to Terms
We may update these Terms as our Service evolves. We'll notify you of material changes via:
- In-app notification
- Email (if provided)
- Updated "Last Updated" date
Continued use after changes means you accept the new Terms.
2. Description of Service
2.1 What Unpanic Provides
Unpanic is a digital wellness tool designed to help individuals with C-PTSD and trauma track triggers, practice grounding exercises, and access AI-powered support. Our Service includes:
- Free features: Box breathing, 5-4-3-2-1 grounding, crisis hotlines, daily mood check-ins, app settings
- Premium features: Mood history & analytics, pattern logger, AI chatbot, sound therapy, coping mechanism tracker
2.2 What Unpanic Is NOT
Unpanic is not a substitute for professional mental health care. We are a supportive tool, not a replacement for:
- Therapy or counseling
- Psychiatric treatment
- Emergency mental health services
- Medical diagnosis or advice
If you are in crisis, please call 988 (Suicide & Crisis Lifeline) or visit your nearest emergency room.
3. Account Registration & Security
3.1 Creating an Account
- You may create an account using email, Google Sign-In, Apple Sign-In, or anonymous authentication
- You must provide accurate information
- You are responsible for maintaining account security
- One account per person (no sharing or selling accounts)
3.2 Account Security
- Keep your login credentials confidential
- Notify us immediately of unauthorized access via security@unpanic.app
- You are responsible for all activity under your account
3.3 Account Termination
You may delete your account at any time through the app settings. We may suspend or terminate accounts that:
- Violate these Terms
- Engage in fraudulent activity
- Abuse or harass other users or support staff
- Attempt to compromise service security
4. Subscription & Payment Terms
4.1 Freemium Model
Unpanic uses a freemium model:
- Free tier: Essential crisis support features always available
- Premium tier: $19.99/month
- 30-day free trial: User-initiated, no automatic charge
4.2 Billing & Renewal
- Subscriptions renew automatically unless canceled
- You'll be charged 24 hours before renewal
- Cancel anytime through your Apple/Google account settings
- No refunds for partial periods (except as required by law)
4.3 Free Trial Terms
- 30-day free trial available to new premium users
- Manually activated (not auto-enrolled during signup)
- Cancel before trial ends to avoid charges
- One free trial per user
4.4 Price Changes
- We may change subscription prices with 30 days' notice
- Existing subscribers keep current price until renewal
- You can cancel before the price increase takes effect
5. Acceptable Use Policy
5.1 You Agree NOT To
- Use the App for illegal purposes
- Share or disclose other users' information
- Attempt to reverse engineer, decompile, or hack the App
- Upload malicious code, viruses, or malware
- Use automated systems (bots, scrapers) without permission
- Impersonate others or create fake accounts
- Harass, abuse, or threaten other users or staff
- Circumvent security features or subscription paywalls
5.2 Content You Create
- You retain ownership of your trigger logs, notes, and mood data
- You grant us a license to process this data to provide the Service
- We will never use your personal health data for advertising or marketing
6. AI Chatbot Terms
6.1 How the Chatbot Works
- Powered by OpenAI/Anthropic APIs with trauma-informed prompting
- Conversation context stored to provide continuity
- No personally identifiable information (PII) sent to AI providers
- Responses are generated, not reviewed by humans
6.2 Chatbot Limitations
- Not a therapist: The chatbot cannot diagnose, treat, or prescribe
- Not infallible: AI may occasionally provide inaccurate or unhelpful responses
- Not a crisis line: For emergencies, call 988 or emergency services
- No guarantees: We don't guarantee specific outcomes from chatbot use
6.3 Your Responsibility
- Use the chatbot as a supportive tool, not a substitute for professional care
- Report harmful or inappropriate responses via the feedback button
- Seek human support when needed
7. Intellectual Property
7.1 Unpanic's Rights
All intellectual property in the App (design, code, branding, content) is owned by Unpanic or our licensors. You may not:
- Copy, modify, or distribute our software
- Use our trademarks without permission
- Create derivative works
- Extract or reuse components of the App
7.2 Your Rights
- You retain ownership of your personal data and content
- You can export and delete your data anytime
- You grant us a limited license to use your data to provide the Service
8. Privacy & Data Use
Your privacy is sacred to us. Please review our Privacy Policy to understand how we collect, use, and protect your data. Key points:
- We never sell your data
- Sensitive data is encrypted locally and in transit
- You control what data is synced to the cloud
- You can delete your data anytime
9. Disclaimers & Limitations of Liability
9.1 Service Provided "As Is"
Unpanic is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability, fitness for a particular purpose
- Accuracy, reliability, or completeness of content
- Uninterrupted or error-free operation
- Security or freedom from viruses
9.2 No Medical Warranty
We do not guarantee any health outcomes. Unpanic is a wellness tool, not medical treatment. Results vary by individual. Always consult qualified healthcare providers for mental health concerns.
9.3 Limitation of Liability
To the maximum extent permitted by law, Unpanic and its affiliates, officers, employees, and partners shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your use or inability to use the Service
- Damages resulting from reliance on AI chatbot responses
- Unauthorized access to or alteration of your data
Maximum liability: Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim (or $100 if you're a free user).
9.4 Exceptions
Some jurisdictions don't allow limitation of liability for personal injury or certain types of damages. In such cases, our liability is limited to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Unpanic, its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or rights of third parties
- Your use or misuse of the Service
- Your content or data
11. Dispute Resolution
11.1 Informal Resolution
Before filing a claim, please contact us at support@unpanic.app to resolve the issue informally. We're committed to fair resolutions.
11.2 Arbitration Agreement (US Users)
For US users, disputes will be resolved through binding arbitration rather than in court, except for:
- Small claims court disputes (under $10,000)
- Intellectual property disputes
- Privacy or data breach claims
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
11.3 Class Action Waiver
You agree to resolve disputes individually, not as part of a class, consolidated, or representative action. This waiver applies unless prohibited by law.
11.4 Governing Law
- US users: Governed by California law (without conflict of law provisions)
- International users: Governed by laws of your jurisdiction where not in conflict with these Terms
12. Force Majeure
We're not liable for delays or failures due to circumstances beyond our reasonable control, including:
- Natural disasters, pandemics, acts of God
- Terrorism, war, civil unrest
- Government actions, strikes, labor disputes
- Internet outages, cyberattacks, third-party service failures (e.g., Firebase downtime)
13. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. The invalid provision will be modified to be enforceable while reflecting our intent.
14. Entire Agreement
These Terms, along with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Unpanic. They supersede any prior agreements or understandings.
15. No Waiver
Our failure to enforce any provision of these Terms doesn't waive our right to enforce it later. All waivers must be in writing.
16. Assignment
You may not transfer or assign your rights under these Terms. We may assign our rights to a successor or affiliate in the event of a merger, acquisition, or sale.
